1. Acceptance of Terms

By joining the waitlist, registering an account, or using AuraWatcher (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions, do not use the Service.

2. Description of Service

AuraWatcher provides AI-powered sentiment analysis of publicly available social media comments for the purpose of reputation monitoring. The Service is a B2B tool intended for professional creators, talent managers, and PR agencies.

3. Billing, Subscriptions, and Cancellations

  • Payments: The Service is billed on a subscription basis. By providing a payment method, you authorize us to charge the applicable subscription fees automatically on a recurring basis.
  • No Refunds: All payments are non-refundable unless otherwise required by law. If you cancel your subscription, you will retain access to the Service until the end of your current billing cycle.
  • Changes: We reserve the right to change our pricing upon giving you advance notice.

4. Acceptable Use

You agree NOT to:

  • Use the Service to harass, stalk, dox, or harm individuals or groups.
  • Attempt to reverse-engineer, scrape, or replicate our AI models, UI, or data pipelines.
  • Use the Service in violation of applicable laws (including GDPR) or the Terms of Service of any monitored social network (e.g., TikTok, Instagram).
  • Resell, sublicense, or white-label access to the Service without our prior written consent.

5. Third-Party Services and Availability

AuraWatcher relies on third-party platforms (such as social networks and AI API providers) to function. We do not control these platforms. If a third-party platform changes its rules, APIs, or layout, the Service may experience interruptions. We are not liable for any downtime, loss of data, or degraded performance caused by third-party actions.

6. Public Data & Platform Compliance

AuraWatcher only analyzes publicly visible content. You are solely responsible for ensuring that your use of the insights derived from the Service is lawful, ethical, and complies with the terms of the monitored platforms.

7. Intellectual Property

All rights in the Service, including the AI models, algorithms, UI, and brand ("AuraWatcher"), are the exclusive property of AuraWatcher. Nothing in these Terms grants you ownership of any part of the Service.

8. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AuraWatcher makes no warranties that alerts will be timely, complete, or error-free. AI sentiment analysis is probabilistic; it may not catch every threat or may generate false positives (e.g., misinterpreting slang). You agree not to rely solely on AuraWatcher for critical crisis management or legal decisions.

9. Limitation of Liability

To the maximum extent permitted by law, AuraWatcher and its founders shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, brand deals, or reputation—arising from your use of or inability to use the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless AuraWatcher from any claims, damages, or legal fees arising from your breach of these Terms, your violation of any law, or your misuse of the Service.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion.

12. Governing Law

These Terms are governed by the laws of Poland and the European Union, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Poland.

13. Changes to Terms

We may update these Terms occasionally. We will notify active users by email of material changes. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
