Terms of Service

1. Acceptance of Terms
By joining the waitlist, registering an account, or using AuraWatcher (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions, do not use the Service.
2. Description of Service
AuraWatcher is a B2B tool that helps professional creators, talent managers, and PR agencies monitor reputational risk in the comments on their own public social media content. The Service collects publicly available comments from social profiles you add. The Service currently supports TikTok, and we expect to add support for additional platforms (such as Instagram, Threads, and X) over time; the platforms available to you are those shown in the product at any given moment. For each flagged comment, the Service generates an automated risk score and assigns a category (such as complaint, allegation, harassment, boycott, legal, or threat) together with a short explanation. The Service may also weigh signals such as a comment's reach and how quickly it is gaining engagement. These outputs are automated estimates, not statements of fact (see Section 8).
3. Billing, Subscriptions, and Cancellations
- Order Processing: Our order process is conducted by our online reseller Paddle. Paddle is the Merchant of Record for all our orders. They process your payments, handle billing inquiries, and manage your subscription. By purchasing a subscription, you are also bound by Paddle's terms and conditions regarding payments.
- Payments: The Service is billed on a subscription basis. By providing a payment method, you authorize us to charge the applicable subscription fees automatically on a recurring basis.
- Refunds and Cancellations: You can cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle, and you will retain access to the Service until then. We do not provide refunds or credits for partial months of service or for months unused with an open account, unless explicitly required by applicable law (such as the EU 14-day right of withdrawal for eligible users).
- Changes: We reserve the right to change our pricing upon giving you advance notice.
4. Acceptable Use
You agree NOT to:
- Use the Service, or any insight, score, or alert it produces, to harass, stalk, dox, threaten, retaliate against, or otherwise harm any individual or group — including any commenter identified in an alert.
- Attempt to reverse-engineer, scrape, or replicate our AI models, UI, or data pipelines.
- Use the Service in violation of applicable laws (including GDPR) or the Terms of Service of any social network you monitor through the Service (for example, TikTok, and any other platforms we add)
- Add or monitor profiles that you do not own or are not authorized to monitor.
- Resell, sublicense, or white-label access to the Service without our prior written consent.
5. Third-Party Services and Availability
AuraWatcher relies on third-party platforms to function, including the social networks it monitors, third-party data providers used to collect public content, and third-party AI providers (currently OpenAI) used to analyze that content. We do not control these platforms. If a third-party platform changes its rules, APIs, or layout, the Service may experience interruptions. We are not liable for any downtime, loss of data, or degraded performance caused by third-party actions.
6. Public Data & Platform Compliance
AuraWatcher only collects content that is publicly visible at the time of collection, and derives scores and categories from that content. We do not request, access, or store passwords or private account data. You are responsible for ensuring that your own use of the insights derived from the Service is lawful and ethical. (Our own handling of personal data is described in our Privacy Policy.)
7. Intellectual Property
All rights in the Service, including the AI models, algorithms, UI, and brand ("AuraWatcher"), are the exclusive property of AuraWatcher. Nothing in these Terms grants you ownership of any part of the Service.
8. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AuraWatcher makes no warranties that alerts will be timely, complete, or error-free. The Service's risk scores and categories are produced by automated, probabilistic AI models; they are estimates only, may be incomplete or wrong, and may misinterpret context, slang, sarcasm, or intent. A flagged category (such as "threat" or "harassment") is a model's assessment, not a factual or legal determination about any person. You agree not to rely solely on AuraWatcher for critical crisis management, legal decisions, or any decision about an individual.
9. Limitation of Liability
To the maximum extent permitted by law, AuraWatcher shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, brand deals, or reputation—arising from your use of or inability to use the Service.
10. Indemnification
You agree to defend, indemnify, and hold harmless AuraWatcher from any claims, damages, or legal fees arising from your breach of these Terms, your violation of any law, or your misuse of the Service.
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion.
12. Governing Law
These Terms are governed by the laws of Poland and the European Union, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Poland.
13. Changes to Terms
We may update these Terms occasionally. We will notify active users by email of material changes. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
